Every Tuesday, USCIS releases its data on the pace of usage of H-1B numbers. I'm monitoring that usage and projecting the end date for H-1B numbers. It's not complicated science, but I'm basically using a rolling average of the prior four weeks of H-1B usage to minimize the anomolies of one particular week and then assuming that usage over the prior month will continue at roughly the same pace. If usage picks up, the exhaustion date will be revised to be sooner and vice versa if usage declines. We actually saw a decline from prior weeks with 800 H-1B applications...

    Hi

I want to transfer my H1-b from a consultant company to a non-profilt organization which is offering me a full time job. I haven't resigned my job at consultant company yet. The LCA process is going on with new non-profilt organisation and then they are going to apply for H-1B petition soon. I am worried if the consultant company will cancel my visa as soon as I resign and that would cause issues for the H-1b transfer. Please advice when is it safe time to resign and start my new job.

    Hi,
I got my PERM labor approved yesterday, for applying I-140 were can I find the processing dates for I-140? I mean specific to Country? Because, if I go to https://egov.uscis.gov/cris/jsps/Pro...viceCenter=NSC the processing time for "Skilled worker or professional" is April, 1 2008, does this date apply for all? Thanks in advance.

    Thanks,
    RK

Folks, I'm in the current sitation. In 6th year of H1B, aplied for PERM labor pending with ATL processing center for >15 mtonhs. Attorneys are filing for 7th year extension. I need to traval in the next 2 weeks but not confident enough to get everything right, I need my visa stamped aswell, which with the current H1B validity, would be onlyuntil 22nd Oct 2009. I did try to convince my Managers that they file the extension under premium processing and I could get extended visa until Oct 2010, but Attorney advised that it is not necessary and I should be fine to go, get my visa stamped and come back.

2 points I'm concerned about are,
    1. Since I have < 6 months validty on current H1B is it safe to travel and I would hopefully have my extsntion reciept number when I go for stamping.
    2. Heard lot about denial of entry at POE, I'm trying to avoid certain airports that I has problems (JFK, EWR etc). Not sure I'm doing enough to be safe.

    Any advise is greatly appreciated.

    Thanks,
    Shrvan

    Interesting

In FY 2007 there were 18 States with over 1,000 certifi
ed PERM positions, and in FY 2008 there were only
    12. Following this trend, there were only eight States
in FY 2009 with over 1,000 certifi ed PERM positions,
and in FY 2009 the number of positions approved in
each of these eight States declined signifi cantly. The
most signifi cant decreases occurred in California, Texas,
and Illinois, where the number of positions approved
declined over 45 percent from FY 2008. The most
demanded occupational positions in FY 2009 were
found in the Information Technology industry, with the
Advanced Manufacturing and Finance industries also
drawing a large number of position requests.

Can I count part time experience obtained before my Bachelors degree for an EB2 petition?

I have 2.5 years of part time experience, can we use this and apply with MBA+1 requirements?

    Thanks

Fancy meeting you here, dohko! The experience at half time can be counted to be 1/2 time itself - i.e. 2 years under 20 hrs./week = 1 yr. full time.
Your experience however has to be obtained AFTER your Bachelor's degree.

In 1729, Jonathon Swift caused quite a stir when he published "A Modest Proposal For Preventing The Children of Poor People in Ireland From Being a Burden to Their Parents or Country, and for Making Them Beneficial to the Public." Swift suggested, in jest, that the Irish eat their own children. This blogger's "Modest Immigration Proposal," will not espouse cannibalism or infanticide, but may be met nonetheless with comparable revulsion by the Immigration Courts. I propose, without a trace of irony, that the Executive Office for Immigration Review (EOIR) should abolish a rule that imposes a form of involuntary servitude...

The Los Angeles Times addresses the case the Supreme Court heard this week regarding the right of an immigrant defendant to competent legal counsel: The right to counsel is one of the glories of this nation's legal system, but it means little if a client can't depend on his lawyer to provide an accurate account of his legal options. This week, the U.S. Supreme Court confronted a compelling case of what can happen when a defendant relies on inaccurate legal advice. Jose Padilla, a legal U.S. resident and a Vietnam veteran, asked the justices to overturn his guilty plea to...
