If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.
If I 140 is rejected then the EAD,AP and I 485 are rejected as well. If you have used EAD then ur H4 is no longer valid ! You will have to go out of the country and get H4 stamped.
So the recommendation is to keep H status alive till you get Greencard

You need to have a labor application filed (need not be approved) 365 days before the expiry of the 6th year in order to get the 7th year extension.

Hi,
I am applying for Citizenship after completing 4 years and 9 months as a Permanent Resident in US.
Can any one please let me know as what is the processing time to get the Citizenship after I apply?
Also I have planned to move to a different State after I apply for Citizenship.
Please let me know whether it fine to move to a different address after applying for Citizenship? Else is this move not advisable?
Does this address change delay my Citizenship processing time?

If your petition has been physically "Mailed" to the Atlanta Service center . Do they give you a tracking number . Can such cases be viewed online on the website http://www.plc.doleta.gov ? How much time does the Atlanta service center take to acknowledge the reciept of such application ?

I am applying for H4 visa after my recent marriage with an H1B visa holder in USA. I am currently filling out the online DS160 form but stuck at the following stage: "travel information"
In the purpose of trip to USA question: the given options are business, travel or student visas, so i selected the option: "other". On selecting this, the form loads a list of further options in order to SPECIFY: the H4 option (dependent of H1B holder) is not given in this list. The nearest applicable option is "temporary employee H1, H2". When I choose this one, then at a much later stage in the application, in the section titled "temporary work visa information" the form starts to ask information on my supposed employer etc, which is clearly UN-applicable in my case, as I am NOT applying for an H1 or H2 visa. Kindly help me out, on how to proceed with DS160 in such a situation. Waiting for reply with anticipatory thanks. Sadatj.

You didn't indicate the reason why your friend's H1B got rejected. If the H1 got rejected due to the problems with the company sponsored the H1, then it's highly likely the new H1 will get approved.

I am nearing the five years on my H1B. My company (A) had it extended with my I-i40 approval. I want to know at this point is it okay to transfer h1B visa to another company (B)? I was told i can only get 9 month extensions with the transfer is that true? Also what if my company (A) cancels my GC process after transferring to company (B), do i have to go through the entire GC process again once I transfer to company (B)? I was told i only have to re apply the I-140 with the priority date given on the previous I-140?

USCIS has not extended its temporary accommodation for delays in the labor condition application (LCA) process. Earlier, USCIS agreed to accept H-1B petitions without a certified LCA, in certain situations, for a limited time. This exception was available from November 5, 2009 to March 9, 2010. don't think their is a set time required. I know people that left their employer the day after gc arrived, know people that left 6 months after their approval and some that have worked for their employer even after receiving their green card for over 4 years. hope this helps

Hello,
1. I last entered US in Dec 2009 on H1B valid till Sep 2012.
2. Was laid off, changed my status to F1.
3. Got new employer, transferred my H1B to the new employer, got approval notice with no I 94 attached. My H1B visa stamping is valid till Sep 2012.
What are my options? Do I need new H1B visa stamping? Or just re enter with new I94?

For what it's worth, I was a Nikon pro card carrier back in the '70's. It was a FABULOUS service. I was allowed to borrow expensive gear for free that I would never have used otherwise (e.g. radio-remote release, medical telephoto with built-in ring flash, nikonos)
And the "go the head of the line" repair service saved me more than once. While I was vacationing in California I needed some urgent repairs and was told by the local main Nikon repair shop that their backlog even for "urgent" repairs was 3 months. I flashed my pro card and it was in the repair shop by 10:00 and out by noon!
