    I have been wanting to post this for the last few days and was happy to read this thread.........can we do something like an Immigrant's Boycott Day or something where we should do a mass boycott all over the country.....we need to coordinate this across the entire country and do a gandhi style protest.....but we need atleast maybe 1000 people per city to do it.....I am not sure how difficult it is to get that many people.....but that seems to be the only way to create an Impact.......WE HAVE TO MAKE OUR EMPLOYERS FEEL THE IMPACT OF NOT HAVING US FOREIGN WORKERS.....THAT IS THE ONLY WAY TO STOP THIS EXPLOITATION........its like when all the mexican farmers stopped working on the strawberry farms.....there were no strawberries in the market....I am in the Detroit, MI area.... we need to come up with a list of big cities where we can get 1000 people per city.


    Hit them where it hurts the most.


    I do not agree with ideas such as this one. We have to be careful not to attract any negative publicity. It is all about perceptions, lets not add to all the negative attitude towards aliens.

    I'm not saying we don't have rights, but what you are asking are the internal workings of a government agency.

    You can't even vote. You can't even just change employers without hassle. You can't even just leave the country and come without proper documents. You can't even apply for a student loan. You can be deported any time you have a problem. You can't even renew your driver's license without showin proof of proper residency.

    Even with GC your rights are still not as good as a US citizen.

    Yes we do have rights.

    But the government is only answerable to a certain level. You cannot ask for information of the internal workings of a government. That's not going to happen.

    We are the USCIS's customers. They wouldn't exist without us. We have a right to make sure that they are being run effectively and efficiently. They have a responsibility to be transparent in their operations, because without that transparency there can be no accountability.

    I don't believe that asking about government processes is beyond our rights. Sure we may not be US citizens, but if an American was in my country being given the run-around by a government organization in my country, I would expect that my country would answer their questions too.

    Any sample letters to Senators with the 'text' outlined for this current cause?
    I'm thinking duly signed letters have more impact.

    We have sent letters in the past only to get a standard CANNED answer. It is my opinion that the letters we send do not have any impact, cos as soon as they see "Immigration" as the subject, they (staff) sends the standard letter they have definining the position back.

    I do not mean to discourage you, but the need of the hour is to call all the senators. There are 100 of them.

    If you were going to do something in addition to the phone calls, Please set up an appointment w/the senator or staff and do a 20 minute Powerpoint presentation. That is more effective.

    could you please provide some reference or more detail to this?

    Not sure about which bank would be good but whichever bank you choose make sure that they give you a statement of how much interest you paid over the year. Most people don't realize that you can deduct interest paid for a home loan in India is tax deductible in the US. Just FYI.

    Looks like they are changing the spillover rules again from Horizontal to Vertical this is bad news for EB2 I

    Because the spillover projection is given only for EB2(China and India). This is due to fact that only EB2-Row is current due to which there is a possbility of spillover which flows to China and India and not to EB3-Row(if it was vertical).

    If we stopped trying every time we failed we would not be here, we would still be in the caves looking for the next big invention.. the wheel.

    Hell, if your folks stopped trying, you wouldn't be here in the first place.. hope you catch my drift :)





    Every time we work on a bill we move a step forward. We have come a long way in the past 2 years. Some bills came and went and did not bring us any relief but that should not stop us from working hard when we see the next window of opportunity.

    The first point on the august visa bulletin says:




    Allocations were made, to the extent possible under the numerical limitations, for the demand received by July 13th in the chronological order of the reported priority dates.

    If the demand could not be satisfied within the statutory or regulatory limits, the category or foreign state in which demand was excessive was deemed oversubscribed.




    does this means a visa was allocated to all applications received by jun 13??

    @OP, Yes. You can open LLC and/or S-Corp on EAD. If you plan on working for the same company, I suggest you do it in the name of your significant other if you are (un)lucky like me and married. Also checkout the option of "LLC filing taxes as a S-Corp". Here is link to more details from IRS.

    I agree. EB3-I would go U for rest of the year.

    I wish EB3-I and EB2-I go to U in this bulletin. It may be possible then, that people will start acting. Else we keep doing this every month. Look what we did this time last year or 2007. Same dreaming about the bulletin and then wait for next month.

    God "make this bulletin U for all folks and , then they will start making some noise atleast"..

    In my area there is no Infopass appointment available before my departure. What is the difference between departing with approval notice in hand and

    with knowing that application has been approved but depart without the physical approval notice in hand before departure and get it aborad if my friend mail it to my place in abroad and later entering with that . Anybody could help in this situation with some advice.

    I know I might get bashed over this - but I don't see the so called "freeloaders" like me to be worthless as donors often tend to accuse.

    In the past, I have doled out valuable information.... and have taken pains to scan my RFE and post it with detailed explanations etc for the benefit of the community. I have replied to people to the best of my knowledge and participated in numerous mailing campaigns. While those efforts may not be even close to what others have done here, I do believe that donations should be just that 'donations' and not turn that into a 'membership'.

    Already I see people asking for exceptions "I have done xyz so I should get free access etc". I'm with that other 'donor' who said that we have enough divisions in our community already.

    Keep in mind that by giving such an incentive to pay, you are also giving a disincentive for people to participate and share their data and their valuable experiences (thats not freeloading!).

    I believe, that was the bone of contention when LK Advani visited USA in 2003 ( I think I read it in Times of India) when India sought the return of SS Tax and Medicare Tax collected from H1B holders who returned to India. I believe it amounts to USD 700 million to USD 1 billion.

    US linked the discussion SS tax return to Indian Police and Military participation in peace keeping in Iraq after US war on terror in Iraq. US insisted that they will return the money to a similar SS system, if India institutes one. US could not win support from world nations (and India) because of this use of (I don't know the term), call it 'link it to something that cannot be done'. You know what I mean.

    Many such policies need to be straightened out. It is a simple fact and nothing complicated about it. Don't collect SS tax and Medicare if the temporary worker is from a country to which US cannot repatriate the money, for whatever reason.

    We all can visualize what difference the return of that 'sweat money' would have meant to the effort on the war on terror. Pure success.

    When you apply for permanent residency in a developed country, you have to cover certain criteria and then you get the approval prior to entering the country. This criteria may include job invitation from a local company (New Zealand recent approach) etc but the point is that the relationship between the potential immigrant and the country-recipient are clear.

    The situation in the US is different - you come here to work temporarily only and you must state that you will return back upon expiration on your visa. On the other hand, there is an option to apply for permanent residence but it is not guaranteed - it is only a possibility.

    OK, I can live whit this approach. But when applying for a GC and would like to BE ABLE TO GET REPLY IN A RESONABLE PERIOD OF TIME - 2-3 months, not 3-4 years ! If approved, I would like to BE ABLE TO GET MY GC IN A REASONABLE PERIOD OF TIME - 6-12 months, not another 5-6 years ! Than I can take a decision what to do and where to go.

    I also do not mind to pay for SS and Medicare. That is OK as long as I get these money back if I do not became a permanent resident/citizen of this country. And I should get it back with an average market interest rate for those 6-7 years. Same if I would have invested them in bonds or so.

    That is a fair approach ! Why I have to state that I am coming here temporarily only and then be forced to pay for SS and Medicare ? Because I am retarded and do not understand what is going on ?!
