My wife has H1B processed in maiden name -(i 797, i-94, stamping). she recently changed her maiden name to married name. she changed her name in SSN and Passport. DMV in NJ are asking to change the name in immigration office. We spoke to the immigration authority and they say there are no relevant forms to make the name change. If anybody have solution let me know.

I agree with you. In order to achieve something, you have to give up something. Either it's the money, labor,time and effort. I sense that apart from very few , rest would like the fruits of labor without any type of contribution and effort. It would take herculean effort to change everyone's attitude. I hope Gandhiji will lend us an invisible hand in our struggle.

I am talking to my immigration attorney right now to get all paperwork filed concurrently.
My attorney say's EAD's are generally approved within 90 days. Will that be before my I-140 is approve or doesn't that matter?

I am sure every company would have their own 'stuck in gc process' alias.
Please start an IV fund drive, so that you can do this on a company basis.

Chase, Union Savings bank, Wells Fargo & Citi. I think if the sales person(agent) talking to us is well informed about our status they will work with the underwriters to get the loan approved- since it helps on their commissions as well.
vrbest, Who is your lender. Can you name the bank you worked with. It might help the some in this group. I have done a Mortgage and 2 re-fi in the past with no issues, but last time, I had issues with Bank of America, Wells Fargo and one other bank (don't remember name). The reason was being on AOS/EAD, They were fine with H1b, but did not understand what EAD / AOS is. It all depends on the underwriter and if he is not knowledgeable on the Visa issues, then you are done. You can't ask for an alternate underwriter. I was able to secure through a credit union though.

One thing I fail to understand, instead of flower compaign why do not we go in for letter compaign. Write letter to DOS and USCIS with copies to members of the congress highlighting all their inefficiencies and inconsistencies. USCIS does not deserve flowers for what it has done to us and what it is doing to us. Do you get flowers and info pass appointment ? Does customer service speak nicely to you and give you right answers ? Do you give flowers to anybody who mistreats you in real life ? I know Munbai ...has impressed a lot but that was a movie. Have you ever realized what would have happened, had it not been a movie ? Things would not have moved at all.

The problem I see with Los Angeles is the high population of illegals. Any thing here looks like pro-illegal.
Doing the rally in other cities in Los Angeles County or Orange County is the media visibility that we can get.

Thanks to everyone who have already sent emails to Ombudsman. We need to do more to get positive results, please go to: http://immigrationvoice.org/forum/sh...ad.php?t=22182 and send those 4 letters.
Others who have not yet acted on this, please go to that thread; download the 4 letters and mail them.
As many people mentioned here and other web sites, the denials are continuing and we need to act now to stop this before it gets even worse.

Hmm so I was quite worried about good old Section 502(d)(2) at first, but after re reading carefully, this may not be terrible. I (and others?) might have pressed the panic button a little too quickly.
As I read it now (and I am NOT a lawyer), any I-140 petition adjudicated after the effective date of this legislation (Oct 2008 seems to be the popular opinion) will be rejected if the I-140 petition has a filing date after May 15th 2007. If this *only* applies to adjudication of I-140s and NOT to I-485s, this means that you would have to have filed your I-140 after May 15th and have it still pending by Oct 2008 .... 14 months for folks filing in the near future. This is quite unlikely, as it takes only a month or so for premium processing, and around 6 months for non-premium.
Folks might get into trouble if they have a labor certification stuck in the BEC and it doesn't get approved for another 12 months or so...

My lawyer received it on Dec 16th - they said that they need at least 2 weeks to answer the RFE. They also mentioned that the RFE doesn''t ask for any specific paperwork , its like a Question-Answer Form.

I think dates won't (and should not ) move much. So at the end of year we can see big jump and then may be people like me can file I-1485.

I am in a bind now, appreciate any advice,
I am planning on using my EAD to switch to another job in a couple of months. Meanwhile I have booked tickets for May 26th to send my son to India for the summer. He has H4 stamped in his passport valid till 2010.
My question is
**Can my son come back on H4 even though I use my EAD to change jobs ?
**Does he need to have advance parole ? Even if I apply for AP tomorrow, chances are very slim that he will get it before he leaves on May 26th.

If you switch Jobs, and you don't have your H1B transfered to the new employer this means your H1B is not valid. No your son can not entry the country on H4 he must use AP. But if you continue to work full time on H1B and work part time on EAD with another employer then he can come on H4.

If USCIS waste another 11,000 visas this year...it is equivalent to one year visas for one country (9,800 EB visas per country per year)....can you imagine that?
The problem is compounded because applicants who supposedly got the visa this year would get the visa allocation from FY2008. That visa number could have been yours....or mine....
