Just asking out of curiosity because when an illegal alien lives and possibly runs from cops from place to place for a period of time then they are qualifed for a green card and eventually citizenship.
Why would they become nice to them after a certain period of time? It is illegal.

I think it takes a week or 10 days to get the receipt and it should have your case number

Hi,
I apologize if I am asking a repeat question.
I received my green card a few months ago but my family haven't received their's yet. As a result they are still using EAD and/or Advance Parole documents. I am considering a job change and in that context I have two questions:
1. Are there any gotchas that I should be aware of - given that my family's cases haven't been approved yet.
2. If I do change jobs, can I apply for EAD and Advance Parole documents for my family on my own? Meaning, without going through the employer.

Can the primary applicant travel on AP while an MTR is filed to appeal the denial for the dependent? NOD was issued as a result of CIS erroneously stating that the non-immigrant status of the dependent lapsed for over 180 days.

I am on my 7th year H1B, valid until next year.
My labor was approved Oct,2007 under EB3 (all education from India).
I-140 was applied in May, 2008 and it has been a frustrating 2+ yrs since I have heard anything. Attorney inquired with the USCIS and got a response that it is still under review.
This delay seems to be very unusual. Do you think this delay is due to my education from India only. I have seen folks with Master's degree from US gettting I-140 in 2 - 6 months max. I am worried that this may turn into a denial.
Anyone has similar experiences with education only from India.? Any advice if I should go for I-140 premium processing or wait ?

My sister is in US in Visitor Visa with I-94 expiration date of Nov 25th 2009. We would like to convert her status from B2 to F1 Visa ASAP.
1) Do you know anyone who has changed the status from B2 and F1? If yes, can you share the experience?
2) Is it risky to do that? What kinds of problem we may encounter?
3) Can she stay in US while F1 is pending? what happens if rejection shows up after her current i-94 expiration date?
4) Is it better to go home country and apply for the F1 Visa or it is safer to change the the status in US.
Any advise you can throw will be appreciated.

I have a pending I- 485 in EB2 and My spouse has a pending 485 in EB3 since 2007. We both are using EAD and on AOS. We got married recently, and my PD became current now.
What is the best way to make use of this situation and add my spouse to my pending 485?
Do we have to file another fresh I - 485 or is there a way to link his EB3 485 application with mine?
If I have to file a new 485, what are the documents needed apart from Marriage certificate, Since my spouse is already on EAD and working, Do I still have to send affidavit of support, my pay slips, w2, EVL etc.? Do we have to send medicals again? Kindly clarify my questions. Help is appreciated.

United States Citizenship and Immigration Services (USCIS) released an updated H-1B cap count of 45,100 as of August 28, 2009. This reflects an increase of 100 cases from the prior count, provided on August 14, 2009. The advanced-degree cap remains at 20,000. The USCIS continues to accept FY2010 H1B cases under the advanced-degree and regular caps.
We suggest to US employers to file H-1B Petitions only if they can able to provide the Client details like Letter from the end-client, Work-orders confirming the placement. If you are having an in-house requirement, provide USCIS with ample proof of your in-house requirements. Considering the flood of H-1B RFEs, we have to be bit cautious in filing works. The standard approach prevailing until last year needs a re-look. Be assured, if you are right on papers and abide the Immigration requirement, you will for sure come with flying colors. We will be happy to help and support you in H-1B and other filings. It is widely believed that the H-1B Cap will be available even after Sept. 30, 2009.
