My friend has his I-485 filed and has got EAD/AP, but the priority date is so behind, that he has no chance of getting a green card before his marriage. So, as I understand he should be able to bring his wife on H4 (as long as he maintains H1). My question is: does he have to re-file for I-485 to include his wife and if so will the priority date remain the same as the first application? She needs to file her own I-485 but only when PD become current. She has the same PD as primary applicant.

If you are having the valid visa, there is no need to go for stamping again. While entering you can show the H1B approval so that you get the I94 till the date on the H1b approval.

I am planning to port my existing priority date from EB3 to EB2. I just wanted to understand the risk I am taking. Could you people do let me know the impact on my exsting PD(EB3 with approved 140) and future 485.
If in case my EB2-140 with PD porting doesnot go through...
I appreciate your thoughtful comments

Hello Attorney,
I have 6 months left on my H1B-I797 to expire. My visa on the passport got expired in 2007. I am planning to go to Tijuana, Mexico for stamping. I work for a financial company for past 4 years. I have approved I140.
Can you please advise if i can get the visa stamped? I have to visit India in May and hence cannot wait until the my H1B extension is filed and approved (based on my approved I140).
I am confused and worried that the consular officer may say that you have less than 6 months of validity on I797 and may deny the visa.
Can any one please advise?
Thanks

hi gurus, a question.
I am currently out of US but working for same company in Europe
I have approved 140, but waiting for PD to be current - (Jan/03, EB3-I).
I am now a sr manager and seem to be eligible for EB1C (if company agrees).
Option 1)
- continue to stay in Europe and apply for 140 (eb1c)+CP
- while waiting for 140 approval, am i eligible for: EAD and AC21 (after 180 days)
Option 2)
-move to US on L1 visa and apply for 140 (eb1c) + 485
Option 3)
- wait for PD for eb3 application to be current
Hope the above makes sense.
Can you pls suggest the best option & approx 'how much time' it will take for option 1 & 2. (understand option 3 is unpredictable).
Thanks

Shortly after we published our last post on January 29, entitled, Is it Time for an End to the H-1B Protectionist Restrictions Applicable To TARP Recipients?, USCIS issued guidance on precisely the issue that the post raised; that is, whether the companies who received TARP funds, but have since repaid them to the government, are still restricted by the H-1B dependent rules? It would be a bit presumptuous on our part to surmise that USCIS policymakers are readers of this blog -- its much more likely that this guidance was issued in anticipation of the impending H-1B filing season rapidly...

Depicting "despair" using a photo and nothing else is tough. A final in one of my photoshop classes was to make a TIME magazine cover that depicted either "despair" or "hope". It was a lot harder to do that we all originally thought.
This comes close but it could also be construed as sadness, anger, weariness, pain, etc.
As I said, that's a very tough emotion to depict in a photo without any supporting text.
By the way, I like the photo.
