Hello - I just recd. the TRANSFER NOTICE for me & my wife's 485 case stating that the case has been transferred to USCIS-NBC, PO Box 648005, Lee's Summit, MO 64064. We had filed for AOS in July 2007 and my priority date for is April 2006 (EB-2).
I would appreciate it if somebody can please shed some light on what this means for us. What are the implications for us.? Will the case be transferred to the local office.? Should i start to gather documents for a interview.
Would appreciate any advice i can get. Thank you!

Good news. The U.S. Citizenship and Immigration Service (USCIS) recently issued guidance on the new H-1B amendment that limits Troubled Asset Relief Program (TARP) recipients� ability to hire H-1B workers. The USCIS confirmed that the new H-1B amendment does not apply to H-1B extensions for current employees with the same employer.
"EAWA does not apply to H-1B petitions seeking to change the status of a
beneficiary already working for the employer in another work-authorized
category. It also does not apply to H-1B petitions seeking an extension
of stay for a current employee with the same employer."

My daughter has joined in a medical program in India and she has to return to US after 4 years to continue her studies. Her 485 is in process and she has stamped H4 upto 2012 ( 3 years from now). I am trying to find out the best strategy to get her here after 4 years if we dont get GC prior to H4 stamping expiry.
Should I continue to apply her EAD and Advance parole whenever she visits US (She will come to US atleast once every year)? Or Can I apply for her EAD and Parole just before the expiry of her h4 stamp (That is after 3 years)? Please advise.

Dear Attorney,
i would like to join a very good opportunity on EAD but have one concern shown below.
"a person has a valid ead/ap and he is gone outside the country for some work purpose and uscis denies his 485 in an illegal way like for eg: (denying AOS applications that have been pending more than 180 days when an employer revokes an I-140). how will he enter USA then ??
can he file MTR when he is outside the US with the help of a lawyer ?"
Your advice will help me alot and would be really appreciated!!!!

I would apply for the renewal EAD now. Are you using the EAD to work ? Normally if the EAD is not approved after 90 day wait, then one can get a temp EAD form the local office. Give yourself some time, just in case something gets dealyed.

You should move this to the Immigrant Visa forum for more responses.
You should notify CIS that you have changed address and ask that the interview be rescheduled. Hopefully you filed the AR-11, change of address forms, with CIS when you moved

Hi,
I had a question regarding the july bulletin where it was mentioned that Old fees is entertained for employment based petetions while family based it would be new fees for I485.
Mine was applied by my company on July 2nd with old fees and Spouse's was applied on August 3rd with old fee and was rejected! I-140 was approved on August 8th and applied in March 2007!
Did they confuse with family based and rejected for fees?
Spouse should also be employment based right!
Can somebody answer my question?

Ok, winter is winding up and summer is here..:):)
There is going to be lots of Indian cultural festivals/Independence day celebrations etc, etc... many opportunities to meet many EB immigrants in these festivals....I have lived in Texas and easily 10k people go to Anand Bazaar (India�s Independence day celebrations)
If all the State chapters co-ordinate a membership campaign, it will be a great success...We should aim at 100k count by this fall..
CAN WE DO IT, let me hear a big YESSSSS ?
We have to come out with a nice one page IV brochure, probably printed in a press in recycled paper (cheaper/good for environment) and circulate in all these functions /festivals. The brochure should explain who we are/what we do/what we have achieved so far(lot), and how EB immigrants will get immense benefit from our forums etc etc...

My wife (H4) & I (H1-B) have valid I94 and visa stamped in out passport for company A until AUG2010.Last September 2008, I have transferred my H1-B to Company B and it got approved and valid until same AUG 2010.Right now I am working for Company B on H1B
When I moved to company B, My previous employer canceled my I140 that triggered 485 denied (For Both).Worked with a Lawyer and filed MTR and my (I am the primary applicant)MTR got approved back in Nov2008.I am still waiting for my wife MTR update. Online status still shows - Case received and pending. (For MTR)
1) I am thinking of transfer my wife H4 to Company B. Is there any issue you guys (seniors) think of?
2) One more question .We both has EAD valid until 09/2010. Both never used EAD. We got our EAD before our 485 denied. Now since my MTR got approved, the EAD is still valid?

Now that new I-140 that I filed with substitute labor is approved. I am looking at possibility how I can use this new I-140.
I heard there is something called changing underlying I-140 application. Can someone explain this and tell me how I can use it in my case please.
