Hi
I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?

Hi guys,
Please provide your valuable thoughts.
I have a Masters degree in the profession I'm working with 2 yrs of work exp prior to starting at this company. Altogether I have 5+ yrs of exp (prior + current).
My job requirements states "BA/BS or equivalent required with 5+ yrs of work exp".
I've read at some sites that if a candidate doesn't have a Masters degree, a Bachelor's + 5 yrs of exp will suffice, but the job description should require a Master's degree. In this case, I have a Master's degre with my job requirement saying "Bachelor's + 5yrs". Will I qualify for EB2? Please suggest.
Also what other options (tweaking requirements a bit) will you suggest?

I am not fully aware of all the benefits of having EAD after filing 485. If you have the knowledge about it could you please list down it in this thread.

as of now it lets the spouse to start working.. & then the not too fancy AC21 portability.. Advanced Parole for trvael outside the US etc..
in terms of GC its just another waiting phase..

Hi
I have started(with a couple of friends) a non profit (University Alumuni association ) recently . Will it affect my GC processing in terms of queries or delays . I had agreed(verbally) to become the financial officer in the company (but have not made any written commitments till now ). The company is registered at my residence address by my friend and collegue although I have not signed any papers and made no financial transactions till date .
Please advice as soon as possible as i need to make sure that the tax return (deadline 15th May is also met with ) and I can get out of the picture if needed.

Folks,
My GC was applied with employer A in Nov-2005. 485 applied during July 2007 fiasco. Even though I have EAD/AP, I have always maintained H1B status.
Recently got H1B transferred to employer B and its approved for 3 years.
My H1B visa (from employer B) will expire this month.
Can I make a trip to India and re-enter using AP, and still maintain H1B status?
I dont want to go through the hassle of going for H1B visa stamping for 10th to 12th year.

I am in L2 visa right now and I have an EAD to work. I got a job that I need to start on oct 01.
My spouse status will change from L1 to H1B from oct 01, as his employer filled for H1B.
Our L1 & L2 are valid until Aug 2011.
I don't have H4 yet.
What are the various options available for me to work?
1. Can I use my EAD to work which is valid until aug 2011?
2. Can I apply for H1B for me? If yes when I can start working with my H1B.
3. Is there is any way to maintain my husband L1 status until it's validity(Aug 2011) and then switching to H1B after L1 expires?

You can have 2 485s pending at the same time - this happens fairly often. Once CIS is ready to approve one, they will ask if you want to withdraw the other. You may not get approved for a second EAD and AP, however, while you have valid versions of these.

Hi,
I'm on F1 visa and recently got married in US..I would like to have my lastname changed in my INDIAN passport.. I will apply for a new INDIAN passport through indian embassy in US..I realized that i will get a new passport with new last name...But my question is what happens to the F1 visa on the old passport and I-94, will they be still valid?...How does it work..what do i need to get them moved over to the new passport...
I know i will have to let my school know about the name change so that they can get me a new I-20 by updating the SEVIS...I've already done that and they are OK with it...
